License of Use and Services Agreement · Radar do Voto
Version 1.3 · In force since October 14, 2026 · Previous versions: 1.2 and 1.1
Summary, does not replace the clauses:
- With the Panels, you are licensing access to online analysis panels, by login. You are not taking the database: the panel runs in the Radar do Voto environment. The only files that leave are the supporting exports (Excel and PDF), stamped with your email, for individual use (clauses 1.9 and 4.6), and the PDF Reports you buy (clause 4.7).
- The raw data is public data from Brazil's Superior Electoral Court (TSE). What you pay for is the way of presenting, slicing and analyzing that data.
- The Product is the Mapa do Voto for the state you choose: the two state panels (1994-2022 Analysis and 2026 Opportunity Map), already with the analysis by neighborhood and by polling place included, plus the Municipal Mapa do Voto for 1 (one) city of your choice (mayor and city councillor by neighborhood and by polling place). Additional cities may be purchased separately.
- There are also the Radar plans, for 30 days or for 1 year: Radar Municipal (the Municipal Mapa do Voto for 1 city of your choice), Radar Estadual (the Analysis for a state, with neighborhood and polling place, and the Municipal Mapa do Voto for all cities in that state) and Radar Brasil (the same, in all 27 states). All include Radar Comparativo (clause 6.11).
- With the Panels, access is individual and in the name of the Contracting Party (individual or company). For the Mapa do Voto, it lasts 1 (one) year from the date of purchase; for the Radar plans, for the period chosen at purchase, 30 (thirty) days or 1 (one) year. Payment is one-time, with one exception: the 30 (thirty) day Radar plan paid by credit card is purchased with automatic renewal, and the same amount is charged every month until the Contracting Party cancels (clause 8.5). Before each charge there is an email notice, and cancellation is done on the site, at any time. With Pix, and on the 1 (one) year plan, payment is always one-time.
- You may not resell, publicly redistribute, republish, host, mass-copy or scrape the panels, nor pass them on to third parties. Each access is stamped with the name of the Contracting Party, who is responsible for the security of the login and for the use made with it; a leak points to its origin.
- Payment through Mercado Pago (card or Pix). No card data passes through Radar do Voto.
- With the PDF Reports, you buy a file, not access. It arrives by email, with a download link valid for 30 (thirty) days, and reflects the TSE data on the day it was generated. If you buy before the TSE releases the data the report uses (the election result or, for the one with neighborhood and school, the votes by polling station), it is a pre-sale: it arrives after that release, with no fixed date.
Purchasing means agreeing to this agreement.
Preamble: the parties
On one side, RADAR DO VOTO ASSESSORIA E CONSULTORIA POLÍTICA E ELEITORAL LTDA, registered under CNPJ 68.178.265/0001-18, hereinafter LICENSOR;
On the other, the individual or legal entity that completes the purchase of any of the products described in clause 6 and accepts this agreement upon payment, hereinafter CONTRACTING PARTY (or LICENSEE), who declares to be over 18 years of age and legally capable of contracting, the product not being intended for minors;
agree to enter into this License of Use and Services Agreement, which is governed by the clauses below and by Brazilian law, in particular the Consumer Protection Code (Law 8,078/1990), the Copyright Law (Law 9,610/1998), the Software Law (Law 9,609/1998), the Industrial Property Law (Law 9,279/1996), the Internet Civil Framework (Law 12,965/2014) and the General Data Protection Law (LGPD (Brazil's General Data Protection Law), Law 13,709/2018).
1. Definitions
For the purposes of this agreement:
1.1. Panel: the interactive online interface, accessible by browser upon login, that presents, organizes and analyzes election results and TSE public data for a state (federative unit). There are two panels per state: the 1994-2022 General Elections Analysis and the 2026 Opportunity Map. The Product (clause 1.7) gives access to both panels, with the neighborhood layer (clause 1.8) included, and to the Municipal Mapa do Voto for a city of choice (clause 1.7.1). The Panel is the object of the license.
1.2. Product: the purchasable offer, as set out in clause 6. It is the Mapa do Voto, always for one state, defined in clauses 1.7 and 6. It gives access to the two panels defined in clause 1.1, with the neighborhood layer (clause 1.8), and to the Municipal Mapa do Voto for a city chosen by the Contracting Party (clause 1.7.1). The Radar plans of clause 6.11 are also Products.
1.3. Access: the credential linked to the Contracting Party (login by link sent to the Contracting Party's email, without a password, the "magic link") that allows opening the Panels of the purchased Product during the term. Access is individual and in the name of the Contracting Party and is intended for the Contracting Party's own use. The Contracting Party is responsible for the security of the credential and for the use made of it.
1.4. TSE public data: the open data files published by the Superior Electoral Court, freely accessible at no cost, which are the raw material of the Panel. The TSE has no ties to the Licensor.
1.5. Licensed content: the selection, organization, slicing, cross-referencing, calculations, texts, charts, design and code that make up the Panel. It is the Licensor's work on the public data, and it is what is licensed, not the data itself, which belongs to everyone.
1.6. Watermark and origin marker: visible and non-visible elements, inserted individually in each Panel, that link that copy to the Contracting Party who purchased it. They serve to identify the origin of an unauthorized redistribution. They exist in every Panel delivered.
1.7. Product. It is the Mapa do Voto, one per state. It comprises:
- (a) access to the two state panels (1994-2022 General Elections Analysis and 2026 Opportunity Map), with the neighborhood layer (clause 1.8) included in both, that is, the Profile by neighborhood in the Analysis and the Neighborhood Sheet in the Opportunity Map, including votes by polling place; and
- (b) the Municipal Mapa do Voto (clause 1.7.1) for 1 (one) city chosen by the Contracting Party, indicated at purchase.
The 2026 Opportunity Map is not sold separately: it is only part of the Mapa do Voto.
1.7.1. Municipal Mapa do Voto and included city. The Municipal Mapa do Voto is the results panel of a city by neighborhood and by polling place (offices of mayor and city councillor). The purchase includes 1 (one) city chosen by the Contracting Party, indicated at the time of purchase, which may be in any state. Additional cities may be purchased separately, by agreement, through the customer service channel (clause 12).
1.7.2. 2026 election. In the state Mapa do Voto and in the Total, the Analysis comes to include the 2026 election for that state, at no additional cost, from the TSE's release of those definitively elected, and the 2026 neighborhood and polling place layer when the TSE publishes the votes by polling station. The Municipal Mapa do Voto does not include 2026, because there is no municipal election in 2026.
1.8. Neighborhood and polling place layer: the slicing of the analysis by neighborhood and by polling place (the school or building where people vote), included in the Mapa do Voto. It comprises the profile and votes by neighborhood and by place, and the result by office in each neighborhood and in each polling place.
1.9. Supporting exports (downloads): files in Excel (.xlsx) and PDF that the Contracting Party may generate from the Panel, with the votes of a candidate by city (in the Analysis) and by neighborhood and by polling place. Each file is stamped with the Contracting Party's email as licensee on every page or sheet ("Licensed to <email>: individual use, do not redistribute"), bears the Radar do Voto logo, is supporting material that does not replace the source, the TSE (clause 11.2), and is subject to the limit in clause 4.6. Exports are not stored on the Licensor's servers after they are generated.
1.10. Report: a PDF file, generated by the Licensor from TSE public data and other public sources indicated in the file itself, that analyzes the 2026 election. It may have more than one volume. It is delivered by email, by link (clause 7.7).
1.11. Candidate Report: a Report on a 2026 candidacy chosen by the Contracting Party, for any office contested in 2026 (federal, state or district deputy, senator, governor or president), at one of two levels:
- (a) Report by city: the votes of the candidacy in 2026 in each municipality of the electoral district (for president, of the country), with the comparison with earlier elections, when available, without neighborhood, polling place or polling station;
- (b) Report with neighborhood and school: the content of level (a) plus the votes by neighborhood and by polling place, which depends on the TSE's publication of the 2026 votes by polling station (clause 7.8).
Whoever buys the Report with neighborhood and school also receives, at no cost, the Report by city for the same candidacy, as soon as it is ready. The Report contains the round already tabulated on the date it is generated; the runoff, when there is one, is not part of the Report generated after the first round, unless the offer states otherwise.
1.12. Place Report: a Report on the 2026 election in a municipality (City Report, without neighborhood or polling place), in a state (State Report) or in the country (Brazil Report), with the comparison with earlier elections.
1.13. Pre-sale: the sale of a Report made before the TSE releases the 2026 data it uses. The price is paid at purchase, and delivery takes place after the release (clauses 7.7 and 7.8).
2. Purpose
2.1. By this agreement, the Licensor grants the Contracting Party a license of use, non-exclusive, individual and in the name of the Contracting Party and for a fixed term, of the Panels corresponding to the Product purchased (including the neighborhood layer and the Municipal Mapa do Voto for the chosen city), for its own use, transfer to third parties being prohibited, under the conditions set out here (in particular clause 4). In the case of a Report, the purpose is the delivery of the file and the license of use of clause 4.7.
2.2. The license is for access to and use of the online Panel. There is no transfer of ownership, nor sale, assignment or delivery of any file, database or software. The Contracting Party does not receive a copy of the database to keep; it receives the right to access the Panel, in the Licensor's environment, for as long as the term lasts. The exceptions are the supporting exports (clause 1.9), which the Contracting Party may generate for individual use, and the Reports (clauses 1.10 to 1.12), delivered as files; none of them constitutes delivery of the database.
3. Nature of the product
3.1. Radar do Voto is a collection and an analysis tool for public data. The Product you acquire is not the electoral information itself, but the work of turning TSE public data into analysis: the slicing by state, the cross-referencing between elections, the indicators, the visual presentation and the reading.
3.2. The Panel is a decision-support tool, not a forecast or guarantee. It does not estimate the result of a future election, does not promise electoral performance and does not replace the analysis of whoever uses it. Clauses 11.1 to 11.4 detail this, and they are not a formality.
3.3. The Licensor is not the TSE and has no ties to the Electoral Justice system. The accuracy of the data is that of the TSE public file on the date of its extraction; where the source differs, the source prevails (clause 11).
3.4. Reading by office in the Opportunity Map. The reading by "votes" (the free vote distributed across the geography) of the 2026 Opportunity Map applies to the proportional offices, State Deputy and Federal Deputy. Governor and Senator are majoritarian elections, decided by majority across the whole state, with no loose vote to aggregate; for these offices the reading is of the contest (margin and stronghold), of a more political nature, and the Panel indicates it where appropriate.
4. License of use and restrictions
4.1. What the Contracting Party may do. Access and use the purchased Panel, for its own purposes (professional, personal, journalistic, academic or campaign), during the term. Access is individual and in the name of the Contracting Party (individual or legal entity) and operates through a single identity (the magic link sent to the Contracting Party's email), being intended for the Contracting Party's own use. The Contracting Party may browse, read, interpret, take screenshots for its own use, generate the supporting exports (clause 4.6) and cite Panel data in its own work. When reproducing an analysis or slice of the Panel, cite "Radar do Voto".
4.2. What the Contracting Party may not do. The following are expressly prohibited, in whole or in part:
- (a) Sharing, assigning, lending, sublicensing or transferring Access to a third party, for any reason, free of charge or for consideration. Access belongs individually to the Contracting Party (individual or legal entity) and may not be passed on.
- (b) Reselling, redistributing or marketing the Panel or the Licensed content, as its own product or a third party's.
- (c) Republishing, hosting, mirroring or making the Panel or its content publicly available on another site, app, repository, social network or channel open to third parties.
- (d) Copying, reproducing or extracting the Panel content in bulk, including by systematic screen capture, with the aim of rebuilding the analysis outside the Licensor's environment, except for the supporting exports of clause 4.6, generated by the Panel's own function and stamped.
- (e) Scraping, sweeping with a robot, script, crawler or automation, or circumventing technical limits on requests, authentication or security, except for the use of the Panel's own export functions (clause 4.6).
- (f) Reverse engineering, decompiling or disassembling the Panel, the code or the calculation logic, or trying to derive the underlying database.
- (g) Removing, hiding or tampering with the watermark, authorship notice, origin marker, licensee stamp on exports or any identification of the Panel.
- (h) Using the Panel for an unlawful purpose, or in a way that violates the rights of a third party.
4.3. The prohibitions in clause 4.2 are supported, as the case may be, by Law 9,610/1998 (copyright), Law 9,609/1998 (software protection), Law 9,279/1996 (industrial property and unfair competition) and the duty of contractual good faith itself (art. 422 of the Civil Code).
4.4. Individualization and traceability. Each Panel delivered is individualized by a watermark and origin marker linked to the Contracting Party (clause 1.6). The supporting exports are likewise individualized by the stamp of the Contracting Party's email as licensee (clauses 1.9 and 4.6).
4.5. Who may acquire and who is responsible for electoral use. The Products may be acquired by anyone, individual or legal entity, including candidates, parties, federations, coalitions and campaign agents. The Licensor provides a tool for analyzing public data (clauses 3 and 11.5) and is not responsible for the electoral use the Contracting Party makes of the Product. It is exclusively up to the Contracting Party (in particular candidates, parties and campaigns) to comply with the electoral legislation applicable to its use of the Panel, including the rules on advertising, on campaign fundraising and spending, and on financial reporting.
4.6. Supporting exports (downloads). The Contracting Party may generate, through the Panel's own function, the supporting exports defined in clause 1.9 (Excel and PDF, by city and by neighborhood and by polling place), provided that:
- (a) each file is stamped with the Contracting Party's email as licensee, for individual use, redistribution, republication and passing on to third parties being prohibited, within the same limits as clause 4.2;
- (b) each paid Panel per state (Analysis, Opportunity Map and Municipal) includes up to 10 (ten) downloads per week, per account, counted by calendar week (Monday to Sunday) in Brasília time and renewed every week; the Licensor may adjust this quantity to preserve the stability of the service, with no retroactive effect on quota already acquired;
- (c) the Contracting Party may acquire, separately, an additional download quota, in packages offered on the site; the acquired quota has no expiration date and remains available in the account until used; consumption takes place first from the free daily downloads and, once these are used up for the day, from the acquired quota;
- (d) the Brazil Panel (presidential results), with free access, is not subject to the download limit of this clause;
- (e) the export is supporting material that does not replace the source, the TSE (clause 11.2);
- (f) removing, hiding or tampering with the licensee stamp is equivalent to the conduct prohibited in clause 4.2 (g).
4.7. License of use of the Report. The Contracting Party receives a non-exclusive, non-transferable license of use of the Report, for an indefinite term, to:
- (a) keep, read, print and use the file for its own purposes, including campaign purposes, and share it internally with its team (the people who work for the Contracting Party or for its campaign), who are subject to the same rules;
- (b) cite data and excerpts of the Report in its own work, with the source "Radar do Voto"; and
- (c) publish, occasionally, pages, excerpts or images of the Report on its social networks, provided that with the credit "Radar do Voto" and the tagging of the @radardovotobrasil profile in the post.
It is prohibited to publish the whole Report or a large part of it, on a site, social network, open group or any channel accessible to third parties; to resell, distribute or assign it to third parties outside the team; and to remove the identification of origin, when there is one. The prohibitions of clause 4.2 apply to the Report, where applicable.
5. Intellectual property and ownership
5.1. The Licensed content belongs to the Licensor: the selection, organization, cross-referencing, texts, charts, design, visual identity and code are the licensor's intellectual work, protected by Law 9,610/1998 and Law 9,609/1998.
5.2. The "Radar do Voto" brand, the logo and the distinctive signs belong to the Licensor and may not be used by the Contracting Party without authorization, except for the citation of the source permitted in clause 4.1.
5.3. The license granted does not transfer any copyright or industrial property right; it transfers only the right to access and use the Panel within the limits of this agreement.
6. Products and prices
6.1. The Mapa do Voto Product is offered, for a state (federative unit) chosen by the Contracting Party at purchase:
| Product | What it includes |
|---|---|
| Mapa do Voto (for the state) | The two state panels (1994-2022 General Elections Analysis and 2026 Opportunity Map), with the neighborhood and polling place layer; and the Municipal Mapa do Voto for 1 (one) city chosen by the Contracting Party (clause 1.7.1) |
| Municipal Mapa do Voto (1 city) | The Municipal Mapa do Voto for 1 (one) city of choice, in any state (clause 1.7.1), without the state panels |
| Mapa do Voto Total (for the state, with all cities) | The state Mapa do Voto and the Municipal Mapa do Voto for all cities in that state |
The price of the Product is the amount in force on the date of purchase, shown on the payment screen, subject to change at any time; the change does not affect a purchase already completed.
No panel is sold separately: the 1994-2022 General Elections Analysis and the 2026 Opportunity Map are always part of the Mapa do Voto.
6.2. The price is a single cash price and includes the applicable taxes. After the payment is approved, Radar do Voto asks the Contracting Party for the data for the service invoice (CPF or CNPJ, Brazilian individual or company taxpayer number; name or company name; email for delivery and, as applicable, address and mobile phone for contact), on the completed purchase screen, in the confirmation email and in the panel. The invoice is issued and sent to the email provided. Installments, when available, follow the rules and surcharges of the payment platform (clause 7).
6.3. Prices may be changed at any time; the price shown on the payment screen at the time of purchase applies. A price change does not affect a purchase already completed.
6.4. Scope of the Product. The Mapa do Voto gives access to the two panels of the same state (1994-2022 General Elections Analysis and 2026 Opportunity Map), with the neighborhood and polling place layer (clause 1.8) included in both, and to the Municipal Mapa do Voto for 1 (one) city of choice (clause 1.7.1). Each Product is valid for one state; there is no Product covering different states, and another state requires a new purchase. Additional cities may be purchased separately (clauses 1.7.1 and 6.6). Radar Brasil (clause 6.11) is the exception: it covers all 27 states.
6.5. Launch price (promotional). The prices charged may include promotional prices. Prices may be adjusted, as set out in clause 6.3. A Contracting Party that purchases while the promotion is in effect pays the promotional price shown on the payment screen at the time of purchase, which is not affected by a later adjustment (clause 6.3).
6.6. Additional cities. In addition to the city included in the Municipal Mapa do Voto (clause 1.7.1), the Contracting Party may purchase another city or more cities separately, through the customer service channel (clause 12), at the price then in force. The purchase of an additional city follows the term of 1 (one) year from the respective purchase (clause 8.1).
6.7. Referral coupon. When available, the referral coupon grants a discount on the Mapa do Voto, in the form and within the limits announced in the offer itself, and cannot be combined with another discount, unless the offer states otherwise.
6.8. Other paid Panels. In addition to the Mapa do Voto, Radar do Voto may offer other paid Panels for analyzing TSE public data, for example Radar das Campanhas (campaign financing: fundraising, donors and spending of each candidate, based on the campaign finance reports published by the TSE) and Radar dos Doadores. What each Product includes, the price and the access period are those shown on the purchase screen at the time of purchase. The other clauses of this agreement apply to these Products, where applicable, in particular clauses 3 (nature), 4 (license and restrictions), 7 (payment and delivery) and 8 (term).
6.9. Reports. In addition to the Panels, the Licensor offers the Reports defined in clauses 1.10 to 1.12. Each Report has its own price, which may vary by type of Report and, for the Candidate Report, by office and by level, and is shown on the purchase screen before payment. The price at the time the order is placed applies (clause 6.3). The Report does not give Access to a Panel, does not use the download quota of clause 4.6 and does not receive the coupon of clause 6.7, unless the offer states otherwise.
6.10. Several Reports in one order. The Contracting Party may choose several Reports and pay for them together, in a single order and a single payment, whose amount is the sum of the prices of each Report at the time of the order. Each Report is delivered in its own email, when it is ready (clause 7.7).
6.11. Radar plans. In addition to the Mapa do Voto of clause 6.1, the Radar plans are offered. Each plan may be purchased for 30 (thirty) days or for 1 (one) year, as the Contracting Party chooses, at the price shown on the payment screen:
| Plan | What it includes |
|---|---|
| Radar Municipal | The Municipal Mapa do Voto (clause 1.7.1) for 1 (one) city chosen by the Contracting Party and Radar Comparativo |
| Radar Estadual | The General Elections Analysis panel for the chosen state, with the neighborhood and polling place layer (clause 1.8); the Municipal Mapa do Voto for all cities in that state; and Radar Comparativo |
| Radar Brasil | What Radar Estadual includes, for all 27 states; and Radar Comparativo |
6.11.1. Radar Comparativo. It is the Panel that compares candidates with each other, by city, by neighborhood and by polling place, across the whole country.
6.11.2. City of Radar Municipal. The city is chosen by the Contracting Party after the payment is confirmed, among the cities with an available panel, and the choice is final.
6.11.3. Scope. Radar Estadual is valid for 1 (one) state; another state requires a new purchase. Radar Brasil covers all 27 states. The Federal District has no municipalities: there, Radar Estadual does not include the Municipal Mapa do Voto.
6.11.4. The Radar plans do not include the 2026 Opportunity Map and do not receive the coupon of clause 6.7, unless the offer states otherwise.
6.11.5. Those who already have the Mapa do Voto. The Radar plans began to be offered on October 14, 2026. A purchase of the Mapa do Voto, made before or after that date, continues for the term and under the conditions of the version of this agreement in force on the date it took place (clause 14.1). Purchasing a Radar plan by someone who already has Access in force does not reduce that Access.
6.11.6. The other clauses of this agreement apply to the Radar plans, in particular clauses 3 (nature), 4 (license and restrictions), 7 (payment and delivery) and 8 (term).
7. Payment, confirmation and delivery of access
7.1. Means of payment. Payment is processed by the Mercado Pago platform, by card or Pix. The payment relationship (charging, anti-fraud, installments, technical chargeback) is also governed by the platform's terms. On the 30 (thirty) day Radar plan, credit card payment is made with automatic renewal (clause 8.5). Payment by Pix, and payment for the 1 (one) year plan, are always one-time.
7.2. No payment data passes through Radar do Voto. The Licensor does not collect, see or store the Contracting Party's card number, Pix key, password or financial data. This data is processed exclusively by the payment platform.
7.3. Confirmation. The purchase is completed with the confirmation of payment by the platform. With Pix, confirmation usually takes seconds; with a card, it may depend on the platform's anti-fraud review and take longer, or be declined.
7.4. Immediate delivery of access. Once payment is confirmed, Access is granted immediately and automatically, by a link sent to the email provided by the Contracting Party. It is the Contracting Party's responsibility to provide a valid email under its control; Access follows the email (clause 1.3), there being no password (clause 10.4).
7.4.1. Credit card on the 30-day Radar plan. In a purchase with automatic renewal, the payment platform confirms the first charge in about 1 (one) hour and may first make a minimum-value charge, only to validate the card, refunded right afterwards. The Licensor may grant Access as soon as the card is accepted, before that confirmation; if the first charge is not approved, Access ends, the renewal is canceled and the Contracting Party is notified by email, with no amount owed.
7.5. As this is digital content with immediate access, whose value lies in the information accessed, the purchase implies the express request for immediate and full commencement of the service. The Contracting Party acknowledges that, once the Panel is granted and accessed, the service is enjoyed immediately and in full, the service being fulfilled at the moment of access. For the Report, the service is fulfilled with the sending of the delivery link to the email provided by the Contracting Party (clause 7.7).
7.6. Failure to deliver Access. With the Panels, if payment was confirmed and Access did not arrive within 1 hour, the Contracting Party should contact support (clause 12). The Licensor regularizes the Access or, if that is not possible, refunds the amount paid.
7.7. Delivery of the Reports. The Report is delivered only by email, to the address of the account that placed the order, with a link to download the file, with no attachment and no need to log in; it is not available in the account's panel. Each Report arrives in its own email.
- (a) Report by city and place reports: the file is generated when the TSE releases the final result of the offices the Report covers, in the respective electoral district (tabulation completed, with those elected declared). As the offer says: "You receive it by email within a few minutes, as soon as the TSE closes the result. Depending on demand, it may take a few hours, but that is unlikely."
- (b) Report with neighborhood and school: follows clause 7.8.
- (c) The link is valid for 30 (thirty) days from sending. Anyone with the link can download the file: downloading and keeping it within that period, and not passing on the link, is the Contracting Party's responsibility.
7.8. Report with neighborhood and school. The Report with neighborhood and school depends on the 2026 votes by polling station, which the TSE publishes after the election, with no fixed date (in 2022 and 2024, this file came out 3 to 5 days after the election). If bought before that publication, it is a pre-sale (clause 1.13): delivery takes place after the TSE publishes that file for the state of the candidacy, and a delay by the TSE does not give the right to a refund. If bought after that publication, the Report is generated and sent right after the payment is confirmed, as in item (a) of clause 7.7.
7.9. Status of the candidacy. A candidacy whose registration was rejected or revoked, or whose votes were annulled, still has a Report, which shows the status as the TSE releases it.
7.10. Date of the data. The Report reflects the data released by the TSE on the date and at the time it was generated, indicated in the file itself. Later changes, including through retabulation, are not incorporated into the delivered Report; for a version with more recent data, a new purchase is required.
8. Term of access and what happens afterwards
8.1. The access period is the one shown on the purchase screen at the time of purchase and varies according to the Product: the Mapa do Voto is in force for 1 (one) year from the date of purchase; the Radar plans (clause 6.11) are in force for 30 (thirty) days or for 1 (one) year, according to the period chosen at purchase, counted from the confirmation of payment; other Panels may have a shorter period, always informed before purchase. In all cases, Access is linked to a cycle. On the 30 (thirty) day Radar plan paid by credit card, the cycles renew automatically, as set out in clause 8.5.
8.1.1. The included city (clause 1.7.1) and any additional cities purchased (clause 6.6) each follow the term of 1 (one) year from the respective purchase. The city of Radar Municipal follows the term of the plan under which it was purchased.
8.1.2. New purchase during the term. On the Radar plans, a new purchase of the same plan adds the new period to what remains, and the purchase of a broader plan applies from the confirmation of payment. In no case does the new purchase reduce Access already purchased.
8.2. At the end of the purchased period, Access ends automatically, except on the 30 (thirty) day Radar plan purchased by credit card, which renews as set out in clause 8.5. The end at the expiration of the period does not give rise to a refund, as it is a known and essential term of the Product, clearly informed before purchase.
8.3. Renewal. Once the period has ended, the Contracting Party who wishes to continue with Access may renew it, under the conditions and at the price in force at the time.
8.4. While the term lasts, the Licensor may update the Panel: correct, complete, reimport TSE data, improve the analysis. An update is a benefit, not an obligation of result.
8.5. Automatic renewal on the 30-day Radar plan. The 30 (thirty) day Radar plan purchased by credit card is purchased with automatic renewal. Those who prefer a one-time payment, without renewal, pay by Pix. The 1 (one) year plan has no automatic renewal: it is always a one-time payment, by Pix or by card, with the installments shown on the payment screen.
8.5.1. How it works. The payment platform charges the plan price to the card provided, every month, and each approved charge gives the right to a new Access period of 30 (thirty) days, which runs until the next charge. The renewal lasts until it is canceled. Each charge is made at once, for the full amount, without installments.
8.5.2. Acceptance. By confirming credit card payment, the Contracting Party accepts automatic renewal. The payment screen shows, next to the form, the amount, the frequency and how to cancel. The acceptance is recorded with the date, time, the text displayed and the version of this agreement.
8.5.3. Notice before each charge. The Licensor sends to the Contracting Party's email, 3 (three) days in advance, a notice of each renewal charge, with the date, the amount and the way to cancel.
8.5.4. Cancellation. The Contracting Party may cancel the renewal at any time, on the site itself, in the account area, without a penalty and without having to give a reason. Cancellation prevents the following charges; Access already paid continues until the end of the current period, without a proportional refund. Cancellation made by the day before the charge avoids that charge.
8.5.5. Charge not approved. If a renewal charge is not approved, the payment platform makes new attempts over the following days, and the Contracting Party is notified by email. Access is valid until the end of the period already paid and is not renewed while the charge is not approved. Without approval at the end of the attempts, the renewal ends, with no debt for the Contracting Party.
8.5.6. Renewal price. Each renewal is charged at the amount accepted at purchase. The Licensor may only change this amount by notifying the Contracting Party by email at least 30 (thirty) days in advance; a Contracting Party who does not agree may cancel the renewal before the charge at the new amount.
8.5.7. Refund and dispute. The refund or dispute of a charge ends Access for the corresponding period and cancels the renewal (clause 9.3).
8.5.8. One renewal at a time. Each account maintains one Radar plan renewal at a time, except for Radar Estadual for different states. To change plans, the Contracting Party cancels the renewal in force.
8.5.9. Earlier purchases. Automatic renewal applies only to purchases made by credit card from this version on. No earlier purchase and no one-time payment will be charged again.
9. Misuse, suspension and termination
9.1. Breach of any prohibition in clause 4.2 authorizes the Licensor to suspend or end Access immediately, without a refund and without prejudice to liability for losses and damages and to the applicable civil and criminal measures.
9.2. Sharing Access with third parties, public redistribution, resale and scraping are considered serious violations. The individualization of each Panel and of each supporting export (clauses 4.4 and 4.6) allows the origin of a leak to be attributed to the responsible Contracting Party.
9.3. The Licensor may terminate this agreement, ending Access or deactivating the Report link, in case of payment fraud (improper chargeback, refund of a purchase already enjoyed) or of use that threatens the security or integrity of the service. The refund or chargeback of a purchase already enjoyed revokes Access and deactivates the Report delivery link.
9.4. Breach of the Report license (clause 4.7), in particular the publication of the whole file or a large part of it, or its resale, authorizes the Licensor to deactivate the link and refuse new deliveries, without refunding the amount and without prejudice to losses and damages.
10. Personal data (LGPD)
10.1. The processing of the Contracting Party's personal data is governed by the Radar do Voto Privacy Policy, which forms part of this agreement for all purposes.
10.2. Controller: RADAR DO VOTO ASSESSORIA E CONSULTORIA POLÍTICA E ELEITORAL LTDA, CNPJ 68.178.265/0001-18.
10.3. To carry out the purchase and grant Access, the Licensor processes the necessary data (in particular email and the purchase identification data), on the basis of the performance of the contract (art. 7, V, of the LGPD) and compliance with legal obligations (art. 7, II, including tax obligations and those of art. 15 of the Internet Civil Framework). Payment data is processed by the payment platform, not by the Licensor (clause 7.2).
10.4. Access is by email, without a password: anyone with access to the Contracting Party's email inbox can open the Panel. Taking care of the security of one's own email account is the Contracting Party's responsibility.
10.5. The rights of the data subject (access, correction, deletion, etc.) and the channel to exercise them are in the Privacy Policy, section 11.
11. Disclaimers and limitation of liability
11.1. The Product is a tool for analyzing public data, and does not guarantee results. The Licensor does not promise, suggest or guarantee electoral performance, number of votes, election of a candidate or any practical effect of the decision the Contracting Party makes with the support of the Panel. Responsibility for the decision lies with whoever makes it.
11.2. Accuracy limited to the source. The information displayed corresponds to the TSE public file on the date of its extraction, stated on the site. The TSE republishes, corrects and completes its files, and later court decisions (removal from office, recount, rejection) do not come in automatically. If there is a discrepancy between the Panel and the TSE, the TSE prevails. The supporting exports (clauses 1.9 and 4.6) are supporting material and follow the same rule. For any use that produces a legal, financial or electoral effect, the Contracting Party must check with the source, the TSE.
11.3. Provided as is. The Panel is offered as available, with no guarantee that it meets a specific purpose not stated by the Licensor.
11.4. Limitation. The Licensor is not liable for indirect damages, lost profits, loss of a chance or of an electoral opportunity arising from the use or inability to use the Panel, nor for decisions made without checking with the source, the TSE. Except as provided in clause 11.5, the Licensor's contractual liability is limited to the amount actually paid by the Contracting Party for the Product.
11.5. No electoral advertising. Radar do Voto is not electoral advertising, neither supports nor opposes any candidate, party, federation or coalition, and the Panel presents the records in the order the vote places them. A purchase by a political agent does not imply the Licensor's endorsement of that agent, and the electoral use of the Product is the exclusive responsibility of whoever purchases it (clause 4.5).
11.6. Automatic readings. The Report contains readings and texts generated automatically from the numbers (for example, where the candidacy gained or lost votes, who shares the voters, the relationship between parliamentary amendments and votes). They are descriptions of public data: they do not assert cause, intention, agreement between candidacies or anyone's conduct, and do not replace the analysis of whoever uses the Report. The relationship between amendments and votes is statistical and does not prove that one thing caused the other.
12. Support and customer service
12.1. The customer service channel, for questions, access problems and complaints, is:
- Email: [email protected] (channel that generates a ticket)
- WhatsApp: +55 11 91111-2892
12.2. For anything that needs proof of date (formal complaint, exercise of LGPD rights), prefer email: a WhatsApp conversation does not generate a ticket.
13. Availability
13.1. The Licensor strives to keep the Panel online during the term, but does not guarantee uninterrupted availability. There may be unavailability due to maintenance, updates (which we choose to always carry out overnight), third-party failure (hosting, content delivery network, payment platform) or force majeure.
14. Changes to this agreement
14.1. The Licensor may change this agreement. A purchase already completed is governed by the version in force on the date it took place: a later change does not affect it, unless it is more favorable to the Contracting Party or required by law.
14.2. The version in force, with its date, is always published at radardovoto.com.
15. Governing law and venue
15.1. Brazilian law applies.
15.2. The courts of the district of São Paulo, capital of the State of São Paulo, are chosen to settle the matters arising from this agreement.
16. General provisions
16.1. Severability. The possible nullity of one clause does not affect the others, which remain in force.
16.2. Tolerance is not waiver. The Licensor's failure to demand any obligation does not mean a waiver of the right to demand it later.
16.3. Entire agreement. This agreement, together with the Privacy Policy and the site's Terms of Use, is the entire understanding between the parties regarding the paid Products, and prevails, as to the purchase, over earlier communications.
16.4. Acceptance. By completing payment and checking agreement with this agreement, the Contracting Party declares that it has read, understood and accepted all clauses, including those on the access period (8) and limitation of liability (11). The acceptance is recorded with date, time and identification, and is valid as an electronic signature (art. 10, §2, of Provisional Measure 2,200-2/2001).
